  1. Whenever any of the following terms appear in these regulations, it should be understood as:

-Customer: a natural person who is 13 years of age, with the proviso that if the person does not turn 18, the consent of his legal representative is required, unless he has full legal capacity, as well as a legal person or an organizational unit does not having legal personality, which the law grants legal capacity, which it uses online store, in particular, who, on the terms set out in these Regulations, places an order via sinternet shop.

  1. These regulations contain the rules for using the online store www.hairbehair.com, in particular, the conclusion of sales contracts through it, the rules for the performance of these contracts, as well as the rules of complaint procedure. 
  2. All products offered by Cosmetic Solutions in the online store are brand new. 
  3. In order to fully use the online store, you must meet the minimum technical requirements. Those are:

  2. Creating a customer account allows customers to use additional functionalities of the online store. 
  3. Creating a customer account is free and voluntary.
  4. Concluding sales contracts by placing an order in the online store is also possible without creating a customer account. However, the Customer Account allows you to check the status of the current order in a specially prepared Customer panel.
  5. The creation of a customer account can be done independently on the website www.hairbehair.com or when placing an order via the online store.
  6. Creating a Customer account requires filling in a registration form, which requires entering your own e-mail address and creating a password. The creation of a customer account is possible only after reading and accepting these regulations, the Cosmetic Solutions privacy policy, and consent to the processing of data required during registration. Providing personal data marked is voluntary, but it may be necessary to place an order - conclude a sales contract. 
  7. After creating the Customer's account, the Customer can log in to it in the online store. 
  8. The Customer may at any time request the removal of the Customer's account along with the data processed with it, free of charge, such request should be sent by letter to the address indicated in point 2 of these Regulations, or via e-mail to the following address: support@hairbehair.com. Such a request must indicate the e-mail address assigned to the account for which the Customer requests removal.
  9. Cosmetic Solutions reserves the right to stop maintaining the Customer's account for important reasons if the Customer uses the Customer's account in breach of point 8 of these regulations.
  10. The customer can purchase the assortment currently offered in the online store by placing an order on the website www.hairbehair.com
  11. Orders in the online store can be placed 24 hours a day, seven days a week and all year round.
  12. The order may be placed by the Customer only if the Customer has read and accepts the terms of these regulations, the terms of the Cosmetic Solutions privacy policy.
  13. Providing the data required to conclude a sales contract is necessary to complete the order. Mandatory data to complete the order are marked as such in the order form. The customer must also consent to the processing of data marked as mandatory in the order form. Providing these data, as well as consenting to their processing is voluntary, but necessary to place an order. Providing data that is not marked as obligatory in the order form is voluntary and is not necessary to place an order.
  14. To finalize the order and conclude a sales contract, the customer should via the online store available at www.hairbehair.com complete the chosen order, fill in the order form subject to point 21 of these regulations, choose the method of delivery of the goods, select the place of delivery of the goods, the method of payment and then confirm the selected order using the "confirm purchase" button. Pressing the button "confirm the purchase" means the conclusion of a sales contract between the Customer and Cosmetic Solutions and is associated with the obligation of payment by the Customer.
  15. Completing an order in the online store is done using the website functionality marked as "basket". The customer adds selected goods in any quantity to the "basket", as described in the online store. After pressing the "checkout" or "ordering" buttons, the items in the "basket" will be transferred to the initiated ordering procedure. 
  16. A customer who has a customer account, after logging in, may place an order in the online store using it. 
  17. With each order, the customer is informed via the online store about the total costs that he is obliged to pay. They include the price of the goods, applicable taxes and the cost of delivering the goods to the customer.
  18. The customer has the right to modify the order at any time, until the button "confirm purchase" is pressed. 
  19. The customer places an order by pressing the "confirm purchase" button. This raises an obligation to pay. 
  20. By pressing the button "confirm the purchase", the customer submits, in accordance with the law of Cosmetic Solutions, an offer to conclude a contract for the sale of goods offered by Cosmetic Solutions in the online store operated by Cosmetic Solutions. 
  21. After pressing the button "confirm the purchase", the customer will receive via e-mail, to the address indicated in the order form, confirmation of his order along with the assigned individual order number. The sales contract between the Customer and Cosmetic Solutions is concluded when the Customer receives this e-mail. The sales contract between the Customer and Cosmetic Solutions is fixed by these regulations, the Cosmetic Solutions privacy policy and the Customer's actions in the online store operated by Cosmetic Solutions.
  22. A customer who has decided to pay in advance is obliged to pay the total cost of the order within 48 hours of receiving the message described in point 29 of these regulations. In accordance with applicable law, the Customer who has decided to pay in advance has the option to withdraw from the contract.
  23. The customer who has decided to pay on delivery, i.e. cash on delivery, is obliged to pay the total cost of the order upon receipt of the package containing the order from the online store.
  24. In accordance with applicable law, a customer who has decided to pay on delivery, i.e. cash on delivery, may withdraw from the contract.
  25. The goods presented in the online store have prices in PLN and are gross prices, i.e. they include the taxes due. 
  26. The prices of goods listed on the website of the online store do not include the costs of delivering the goods to the customer. The cost of delivering the goods to the customer is visible when ordering and varies depending on the personal choice of the customer, ie the form of delivery. When placing an order, the total cost of the order is always visible in accordance with point 25 of these regulations.
  27. The final and binding price of the selected products, i.e. the total amount of the order in accordance with point 25 of these regulations, is also an amount expressed in PLN and including all applicable taxes. This is a binding price. 
  28. The payment methods currently available in the online store are VISA, VISA Electron, MasterCard, MasterCard Electronic and Maestro payment cards. In the event of a need to return funds for an order placed by the Customer with a batch of Cosmetic Solutions, the refund will be made to the bank account assigned to the Customer's card.
  29. An order paid in advance in accordance with point 30. with the card is considered one for which a positive transaction authorization has been obtained. 
  30. The goods offered by Cosmetic Solutions in the online store are delivered to customers on working days.
  31. Each order confirmed via the online store operated by Cosmetic Solutions will be accompanied by a receipt covering the subject of the order.
  32. According to Art. 27 of the Act of 30 May 2014 on consumer rights (Journal of Laws of 2019, item 134). A consumer who has concluded a distance contract may withdraw from this contract within 14 days without giving any reason and without incurring costs, except for the costs of customs duties and taxes related to the return of the goods.
  33. In the event of the Customer withdrawing from the contract, Cosmetic Solutions undertakes to return immediately, no later than 14 days from the date of withdrawal by the Customer from the contract, the entire payment made by the Customer. 
  34. The period for which it is possible to legally withdraw from the contract begins on the day of concluding the contract between the Customer and Cosmetic Solutions. 
  35. The customer may withdraw from the contract by informing Cosmetic Solutions about it via e-mail to the following address: support@hairbebair.comor in writing to the address of Cosmetic Solutions spółka z ograniczoną odpowiedzialnością, ul. Twarda 18, 00-105 Warsaw with the annotation "Return". Withdrawal from the contract should take place by expressing the Customer's will. 
  36. To meet the deadline referred to in point 42 of these Regulations, it is sufficient for the Customer to send the declaration of intent referred to in point 43 of these Regulations before the expiry of the period specified by law allowing for withdrawal from the contract. 
  37. Cosmetic Solutions reserves the right to withhold the reimbursement of the Customer's payment until it receives the returned goods from the Customer or until the Customer receives confirmation of sending the returned goods to Cosmetic Solutions - whichever occurs first. 
  38. The customer is responsible for the decrease in the value of the goods as a result of activities other than those necessary to establish the nature, characteristics and functioning of the goods.
  39. Cosmetic Solutions kindly informs that pursuant to Art. 38 item 5 of the Consumer Rights Act excludes the right to return the goods used by the Customer, if their return is not possible due to hygiene and health protection reasons. This provision does not affect the Customer's right to return the goods resulting from the provisions of applicable law.
  40. Cosmetic Solutions makes every effort to provide its customers with the offered goods without any physical and legal defects. Cosmetic Solutions is liable for physical and legal defects of the goods in accordance with the Act of 23 April 1964 Civil Code (consolidated text, Journal of Laws of 2018, item 1025, as amended), in particular in art. 556 and following of the Civil Code. 
  41. The complaint may be submitted by the Customer via e-mail to the following address: support@hairbehair.comor in writing to the address of Cosmetic Solutions spółka z ograniczoną odpowiedzialnością, ul. Twarda 18, 00-105 Warsaw with the annotation "Complaint". 
  42. Cosmetic Solutions, in order to improve the complaint process, kindly asks you to include in the application described in point 49. data enabling the initiation of the complaint process and identification of the Customer's transaction, in particular the Customer's name and surname, customer's address, e-mail address (e-mail) of the Customer [if the customer wishes to receive a reply to the complaint by e-mail], the date of purchase of the goods, the advertised product, a detailed description of the defect of the product being complained about, the date when the defect was discovered by the customer and the customer's request, as well as the customer's preferred method of informing him about the complaint being considered by Cosmetic Solutions. Please attach proof of purchase to the application, i.e. a copy of the receipt or invoice. The content of the complaint suggested in point 50 of these regulations is only proposed. Its use by the Customer is voluntary and does not affect the effectiveness of the complaint. The customer may voluntarily make his own complaint, which will not affect its effectiveness.
  43. The customer exercising his warranty rights is obliged to deliver the defective goods at the expense of Cosmetic Solutions to the address of Cosmetic Solutions Spółka z ograniczoną odpowiedzialnością, ul. Twarda 18, 00-105 Warsaw with the annotation "Complaint". 
  44. Cosmetic Solutions will consider the submitted complaint immediately, but not later than within 14 days from the date of its submission. The method of handling the complaint by Cosmetic Solutions will be communicated to the Customer in accordance with his will expressed in the complaint.
  45. The customer can read the detailed information on out-of-court methods of dealing with complaints and pursuing their claims, as well as the rules of access to these procedures at the offices and on the websites of poviat (municipal) consumer ombudsmen, social organizations whose statutory tasks include consumer protection, voivodeship inspectorates of the Inspection Handlowa and at the following addresses of the Office of Competition and Consumer Protection: www.uokik.gov.pl/spory_konsumenckie.php, https://uokik.gov.pl/pozasadowe_rozwiazywanie_sporow_konsumenckich.php, www.uokik.gov.pl/wazne_adresy.php, www.uokik.gov.pl/sprawy_indywidualne.php.
  46. The customer may also take advantage of free assistance in resolving the dispute between him and Cosmetic Solutions offered by social organizations such as the Consumers' Federation running its website at www.federacja-konsumentow.org.pl
  47. The customer may also use the help of the European Consumer Centers Network. On the website www.konsument.gov.pl the addresses of these institutions are available.
  48. The Customer who is a Consumer has, inter alia, the following options to use an out-of-court dispute resolution between the Consumer and Cosmetic Solutions: referring to the provincial inspector of the Trade Inspection
    with a request to initiate an out-of-court dispute resolution procedure between the Consumer and Cosmetic Solutions by enabling the parties to approximate their positions in order to resolve the dispute by the parties or by presenting the parties with a proposal to resolve the dispute, and is entitled to refer to a permanent arbitration court operating at the voivodeship inspector of the Inspection Handlowa with a request to resolve a dispute arising from the concluded sales contract.
  49.  The Trade Inspection is an entity authorized to conduct proceedings regarding out-of-court resolution of consumer disputes. The tasks of the Trade Inspection in the scope of conducting proceedings regarding out-of-court settlement of consumer disputes as well as organizing and running permanent arbitration courts are performed by the locally competent provincial inspectors of the Trade Inspection. The list of institutions dealing with out-of-court resolution of consumer disputes along with information on the type of cases dealt with by individual entities is available on the website of the Office of Competition and Consumer Protection at www.uokik.gov.pl. At the President of the Office of Competition and Consumer Protection, there is also a contact point for out-of-court resolution of consumer disputes and an online consumer dispute resolution system, whose tasks include, inter alia, providing assistance to Consumers in cases relating to out-of-court resolution of consumer disputes, in particular in disputes arising from cross-border contracts. concluded with consumers.
  51. The consumer may use the platform of the online consumer dispute resolution system (ODR platform), in accordance with Regulation (EU) No 524/2013 of the European Parliament and of the Council of May 21, 2013 on online dispute resolution for consumer disputes and amending Regulation (EC) No. 2006/2004 and Directive 2009/22 / EC (Regulation on ODR in consumer disputes). The European ODR platform is to facilitate independent, impartial, transparent, effective, fast and fair out-of-court settlement of disputes online between consumers and entrepreneurs regarding contractual obligations arising from online sales contracts or contracts for the provision of services concluded between consumers living in the European Union and entrepreneurs established in The Internet address of the ODR platform is www.ec.europa.eu/consumers/odr.
  52. The customer may voluntarily use his extrajudicial means of dealing with complaints and pursuing his claims. It is possible after the complaint procedure is completed and requires the consent of both parties to the procedure. Cosmetic Solutions agrees to attempt an out-of-court settlement of the dispute. 
  53. All prices presented in the online store operated by Cosmetic Solutions do not constitute an offer within the meaning of the provisions of the Act of
    April 23, 1964 Civil Code (consolidated text, Journal of Laws of 2018, item 1025, as amended)
  54. Cosmetic Solutions complies with all rights of the Customer provided for in the provisions of applicable law, in particular those provided for in the provisions of the Act of 23 April 1964 Civil Code (consolidated text, Journal of Laws of 2018, item 1025, as amended) and the Act on on May 30, 2014 on consumer rights (Journal of Laws of 2017, item 683). The provisions of these regulations are not intended to limit or exclude any rights of customers under the law.
  55. These regulations are publicly available and free of charge on the website available at www.hairbehair.com/pages/regulamin. These Regulations may be recorded, reproduced and reproduced via the ICT system selected by the Customer. 
  56. Cosmetic Solutions reserves the right to amend these regulations for legal or organizational reasons. Each customer who has a customer account will be informed by Cosmetic Solutions via e-mail to the address assigned to the account about the change in the regulations at least 14 days before the changes come into force. The customer then has the right to accept or refuse to accept the new regulations. Refusal to accept the regulations is associated with the withdrawal of the Customer's consent to the processing of his data and the cessation of maintaining the Customer's account. At the same time, the changed regulations will be presented on the website www.hairbehair.com for at least 14 days before the amendments come into force. 
  57. In the event of a change to these Regulations, all contracts concluded and orders placed before the date of entry into force of the amendment to the Regulations will be implemented in accordance with the Regulations in the wording in force on the date of conclusion of the contract and placing the order by the Customer.
  58. In matters not covered by these Regulations, the provisions of Polish law shall apply, in particular the Act of 23 April 1964 Civil Code (consolidated text, Journal of Laws of 2017, item 459, as amended), and in the case of Customers who are Consumers also provisions of the Act of 30 May 2014 on consumer rights (Journal of Laws of 2017, item 683).
